Custody and Visitation
Louisiana values the best interest of the child. Each custody and visitation arrangement requires a personalized solution because no two children are the same. Two components to custody are legal custody and physical custody. In a perfect world, it is always best when parents can agree, but most often than not, parties cannot agree on a custody plan. Divorce
Divorce can be painful, but you can get through it and be stronger on the other side. A divorce can either be contested or uncontested and most are commonly filed as “no fault” divorce. Such process can be overwhelming. A divorce can be filed before or after the required period of separation. Louisiana requires parties with minor child to be separated at least 365 days and at least 180 days with no minor children. However, in limited circumstances, a divorce can end sooner if “fault” based. Louisiana recognizes olographic or notarial acts as long as the statutory requirements are met. A will is a written and signed document directing the distribution of your assets at death. If you own real or personal property you should consider a will to ensure the things you worked hard to earn are distributed according to your wishes upon death.
Living Wills
A living will is a written declaration which provides a person desires for life sustaining medical procedures in the event of a terminal or irreversible condition. Basically, this type of will allows a person to make important life sustaining decisions before it is too late.
Powers of Attorney
Preparation is always key! Do not wait until it is too late! In the event something happens to you or a loved one, a power of attorney will allow the person of your choice to act in a wide range of matters, both financial and healthcare related, at such critical time on your behalf.
Trusts
Louisiana recognizes revocable and irrevocable trust. Trusts are created for various reasons, but are mostly used to hold assets for minor children and to provide for spouses.
Succession
When a loved one dies their estate must be collected, debts and taxes must be paid, and the estate must be distributed according to the decedent’s will or state law. During a succession, all assets must be transferred to the deceased’s heirs/legatees. Assets are transferred by placing the heirs/legatees in possession. There are two types of successions, see below:
- Testate – An estate is testate if the deceased person left a will. A person who inherits under a will is called a legatee. The property in a testate succession is transferred to the legatees by opening succession.
- Intestate – An estate is intestate if the decedent did not leave a valid will. A person who inherits under the law of intestate successions is referred to as an heir. Heirs are placed in possession with the property of the estate by opening succession or depending on the value of the estate – affidavit by small succession.
